Terms and Conditions

I. General Information

"User" means any natural person who accesses the Service, whether or not they have created an account. "Service" means the Student Housing mobile application and the student-housing.app website, together with the functions made available through them. "Provider" means TINT TECH S.R.L., operator of the Service, hereinafter referred to as "the Provider" (registration details in the Legal Notice). "Listing" means a property advertisement published by a User through the Service. "Content" means any listing, message, profile information, photograph, or other material submitted by a User.

These Terms govern the User's access to, and use of, the Service, including the browsing of listings without an account, the creation of an account, the publication and browsing of listings, communication between Users, and any related function made available through the Service. Certain functions — including saving favorites, messaging, publishing listings, and joining a roommate group — require an account. By browsing the Service, creating an account, or otherwise using the Service, the User accepts these Terms in full.

II. User Obligations

Each time the User accesses the Service, the User undertakes:

• to be at least 16 years of age, or the minimum age of consent applicable in their country of residence, whichever is higher;
• to act lawfully and to provide accurate, current, and complete information when creating an account or publishing a listing, and to keep such information up to date;
• not to copy, scrape, reproduce, or redistribute Content or data made available through the Service beyond what is necessary for personal, non-commercial use of the Service;
• not to use the Service to transmit content that is unlawful, defamatory, fraudulent, hateful, obscene, or that infringes the rights of any third party, and not to harass, threaten, or discriminate against other Users;
• not to impersonate any person, misrepresent their affiliation, or misrepresent their identity, their status as a student, or the accuracy of any listing published through the Service;
• not to collect or harvest data about other Users, send unsolicited communications, or use the Service to send spam;
• not to attempt unauthorized access to the Service, its infrastructure, or the accounts of other Users, or to interfere with, disrupt, or bypass any security or usage limit of the Service; and
• to be solely responsible for the accuracy of any information entered about a third party, such as a tenant named on a listing, and to have obtained that person's consent where required by law prior to entering their data.

III. User-Generated Content

Listings, messages, profile information, and other Content are created and published by Users, and are not verified or endorsed by the Provider prior to publication. The Provider may, at its discretion, remove or restrict access to any Content, or suspend or terminate a User's account, that appears to violate these Terms or applicable law, whether following a report or on its own initiative, without prior notice.

The Service includes User-to-User messaging. The Provider may access, review, or remove messages and other Content where necessary to enforce these Terms, comply with applicable law, or protect the safety of Users, consistent with the Privacy Policy.

By publishing a listing, the User grants other Users of the Service the right to view its content, including any contact details provided, and grants the Provider the right to display, store, and distribute that Content within the Service for as long as the listing remains active. The User retains ownership of the Content they submit; this license does not transfer ownership.

IV. Student Verification

The Service may display a "verified student" indicator on a User's profile where that User has confirmed ownership of a recognized institutional (university) email address. This indicator confirms only that a university email address was verified at a point in time; it is not a guarantee of the User's identity, enrollment status, or trustworthiness, and the Provider makes no representation to that effect.

V. Accuracy of Information

The Provider does not verify the accuracy, completeness, or legality of listings or of information entered by Users, and makes no representation that any listing is available, correctly priced, or otherwise as described. The Provider is not a party to any rental, tenancy, or other agreement between Users, and does not own, manage, inspect, or guarantee any listed property. Users are solely responsible for verifying, before entering into any arrangement with another User, the accuracy of any information exchanged through the Service and the identity and intentions of the other party. Users should never send money or a deposit to another User without independently verifying the property and the person.

VI. Limitation of Liability

a) The User expressly acknowledges and agrees that:

• use of the Service is at the User's own risk;
• the Provider does not guarantee that the Service will be available at all times, free of errors, or free of interruptions;
• the Provider is not a party to, and assumes no liability for, any arrangement, tenancy, or agreement entered into between Users as a result of using the Service; and
• the Provider is not liable for any loss or damage arising from a User's reliance on Content published by another User, including inaccurate listings or misrepresentations made in correspondence, or from any dealing between Users.

b) To the maximum extent permitted by law, the Provider's aggregate liability toward a User arising out of or in connection with the use of the Service — including any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill — is limited to EUR 100 per event or series of related events, except for liability that cannot be limited or excluded under applicable law, including liability for intent, gross negligence, fraud, or death or personal injury caused by negligence.

VII. Indemnification

The User agrees to indemnify and hold harmless the Provider from any claim, damage, liability, or expense (including reasonable legal fees) arising out of the User's Content, the User's use of the Service, or the User's violation of these Terms or of any law or third-party right.

VIII. Termination

The User may delete their account at any time from the application's account settings, which terminates these Terms as between the User and the Provider, subject to the data-retention terms described in the Privacy Policy. The Provider may suspend or terminate a User's access to the Service, in whole or in part, with or without notice, where the User breaches these Terms, engages in fraudulent or abusive conduct, or where required by law, or if the Provider discontinues the Service. Provisions that by their nature should survive termination — including Content licenses already granted, disclaimers, and limitations of liability — will survive.

IX. Fees and Payments

Access to the Service's core functions — creating an account, publishing listings, searching, messaging, and favorites — is free of charge. The Provider may, in the future, offer optional paid features, such as promoted listings, on terms and pricing to be communicated at the time such features are introduced; use of a paid feature is subject to the pricing and payment terms displayed at the point of purchase. Where a paid feature involves a payment processed by a third-party payment provider, that provider's own terms also apply to the payment.

Where the User is a consumer within the meaning of applicable law and purchases a paid feature through the Service, the User has the right to withdraw from that purchase within 14 days without penalty, provided that performance of the paid feature has not already begun with the User's express consent and acknowledgment of the loss of the withdrawal right.

X. Complaints

Complaints or suggestions regarding the Service may be submitted to contact@tinttechhub.com. The Provider will endeavor to respond within 30 days.

XI. Security

The User is responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account. The Provider is not liable for unauthorized access resulting from the User's failure to keep their credentials secure. Transmission of information over the internet cannot be guaranteed to be entirely secure.

XII. Cookies

The website uses only cookies strictly necessary for its operation and does not use analytics or advertising cookies. The mobile application does not use cookies but may process comparable device identifiers, as described in the Privacy Policy.

XIII. Advertising and Links to Other Services

The application displays advertising through Google AdMob and relies on third-party services, including Google Firebase and mapping and geocoding providers. The Service may also contain links to third-party services, such as messaging applications used to contact a listing owner. The Provider is not responsible for the content, accuracy, or practices of any third-party service, including advertisements and any linked website, and the User's use of those features may be subject to the third party's own terms and policies.

XIV. Intellectual Property

The Service, including its name, logo, design, and underlying software (excluding Content), is the property of the Provider or its licensors and is protected by applicable intellectual property law. The Provider grants the User a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, non-commercial purpose. Users retain ownership of the Content they submit, but grant the Provider the license described in Section III above for as long as that Content remains published through the Service. The User may not copy, modify, reverse engineer, or create derivative works from the Service except as permitted by law.

XV. Personal Data

The processing of personal data in connection with the Service is described in the Provider's Privacy Policy, which forms part of these Terms.

XVI. General Provisions

• The Provider may amend these Terms as the Service evolves; the current version is always available on this page, and continued use of the Service after a change takes effect constitutes acceptance of the amended Terms.
• The Provider is not liable for any failure to perform its obligations under these Terms where such failure results from circumstances beyond its reasonable control.
• These Terms are governed by the laws of Romania, without prejudice to any mandatory consumer-protection provisions of the country in which the User resides; disputes will be submitted to the competent courts of Bucharest, Romania, unless applicable law provides otherwise.
• If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
